Pobre ángel si lo devuelven

al infierno de su patria.

Si Elián toma por la ruta

de regreso a la desgracia,

al pie de la madre muerta

se le muere la esperanza.

Al ruiseñor infantil

le aplastarïan las alas,

y no podrïa volar

tras las rejas de una jaula.

Si hay un luto de delfines

ennegreciendo las aguas,

otro luto gallin ceo

recorre la Casa Blanca.

El rubio de la sonrisa

quiere engañar y se engaña:

La libertad, señor Clinton,

es mucho más que una Estatua.

Los matadores de niños,

los hundidores de balsas,

con la desdicha de Elián

quieren proclamar su zafra.

No invoquen las frïas leyes

que manos frïas redactan,

ni la patria potestad,

ni los papeles sin alma,

ni los derechos de un padre

acosado por la infamia.

En Cuba hay un solo padre,

dueño de rïos y palmas,

dueño de bestias y esclavos,

y dueño de la palabra.

En Cuba hay un solo padre,

que es un Herodes con barbas.

 

Elian: La ley comunista prueba por que no debe regresar.

Se ha escrito mucho sobre por qué Elián no debe regresar a Cuba. Los

argumentos son legión pero este trabajo va a encaminado a desinflar el

argumento del servicio de Inmigración de que el padre tiene patria potestad y

es el único que puede hablar por el niño. Pero aunque eso fuera así no tiene

derecho a someter a su hijo a una vida de persecución como fue decidido en un

caso famoso en Chicago en 1980.

En efecto Walter Polovchak tenía 12 años cuando, estando de visita con su

padre en Chicago, decidió quedarse. Walter tomó su bicicleta y se fugó al

apartamento de su primo. El padre quería que volviese a Ucrania y recurrió a

la policía. Walter fue apoyado por un abogado que tomó el caso pro bono. Se

impidió el regreso forzoso y después de luchar 5 años contra su padre

prevalecieron sus deseos cuando arribó a los 18 años y le fue dada la

ciudadanía americana. Pero al ampararlo el juez decidió que los niños

también tenían derecho a ser protegidos contra la persecución sin importar lo

que decía el padre pues el juez falló que la patria potestad no era absoluta.

Y es de sentido común. La Patria Potestad se ejerce en beneficio del menor y

nunca en su perjuicio. Es un principio básico del derecho de familia.

Aparentemente el servicio de inmigración estima que en Cuba no existe

persecución.

Preferiría no citar demasiadas leyes marxistas pero es indispensable pues

ellas mismas prueban el caso. Veamos pues los preceptos del código de la

niñez comunista que han sido ignorados por el servicio de inmigración e

influyen decisivamente, en el argumento sobre la persecución que sufre el

joven en Cuba.

" Código de la niñez. Ley No. 16 de 28 de Junio de 1978. Gaceta Oficial de 30

de Junio de 1978.

Art. 3. La formación comunista de la joven generación es un apreciada

aspiración del Estado, la familia, los educadores, las organizaciones

políticas, y de masas que actúan para que....surjan y se desarrollen en los

jóvenes los valores ideológicos del comunismo.

Art. 5. La sociedad y el Estado velan porque las personas que se vinculan a

los niños y jóvenes en el proceso educativo constituyan un ejemplo para la

formación de su personalidad comunista.

Art. 8. La sociedad y el Estado trabajan por la eficaz protección de los

jóvenes ante toda influencia contraria a su formación comunista.

Art.18. Los educadores tienen una elevada misión en la formación de la persona

lidad comunista.

Art.23. Al terminar la enseñanza básica los jóvenes pueden continuar los

estudios en institutos preuniversitarios, centros politécnicos o dedicados a

otras enseñanzas especializadas sobre la base de los rendimientos académicos,

actitud política y conducta social

art33. El Estado concede particular atención a la enseñanza del marxismo

leninismo por su importancia para la formación ideológica y la cultura

política de los jóvenes estudiantes.

Art. 68 Los niños y jóvenes se preparan para la educación patriótica militar,

la adquisición de conocimientos militares, los cursos de prereclutas, la

incorporación de los jóvenes al servicio militar activo.....haciendo suyos

los principios del internacionalismo proletario y de la solidaridad

combativa."

¿Qué más pruebas de persecución son necesarias? La personalidad tiene que

cambiar según la ley.

Hay que evitar cualquier influencia en contra, se progresa en la escuela

según la actitud política y para remachar la constitución comunista/cubana

según fue reformada en el 92 declara:

"Artículo 39.- El Estado orienta, fomenta y promueve la educación..... En su

política educativa y cultural se atiene a los postulados siguientes:

a) fundamenta su política educacional y cultural en los avances de la ciencia

y la técnica, el ideario marxista

c) promover la educación patriótica y la formación comunista de las nuevas

generaciones y la preparación de los niños, jóvenes y adultos para la vida

social. Para realizar este principio se combinan la educación general y las

especializadas de car cter científico, técnico o artístico, con el trabajo,

la investigación para el desarrollo, la educación física, el deporte y la

participación en actividades políticas, sociales y de preparación militar."

"Artículo 62.- Ninguna de las libertades reconocidas a los ciudadanos puede

ser ejercida contra lo establecido en la Constitución y las leyes, ni contra

la existencia y fines del Estado socialista, ni contra la decisión del pueblo

cubano de construir el socialismo y el comunismo. La infracción de este

principio es punible.

Esta más que claro: o se es comunista o se delinque.

Y ahora comparemos lo que dice la humanidad en un documento conocido por

todos dada su amplia difusión, la Declaración de los Derechos Humanos de 10

de diciembre de1948.

Artículo 26

Toda persona tiene derecho a la educación.

La educación tendrá por objeto el pleno desarrollo de la personalidad humana

y el fortalecimiento del respeto a los derechos humanos y a las libertades

fundamentales...

Los padres tendrán derecho preferente a escoger el tipo de educación que

habr de darse a sus hijos.

Artículo 12

Nadie ser objeto de injerencias arbitrarias en su vida privada, su familia,

su domicilio o su correspondencia, ni de ataques a su honra o a su

reputación. Toda persona tiene derecho a la protección de la ley contra tales

injerencias o ataques.

La Patria potestad que se alega en el caso de Elian no existe pues la ley

cubana/marxista actual en violación del derecho internacional y tradicional

de Cuba y se arroga el derecho de educar, adoctrinar y cambiar la

personalidad.

Esos derechos son tan básicos y pertenecen a los padres en una forma tal que

están en todos los códigos civilizados del mundo y en la declaración de

derechos humanos desde 1948.

Cambiar la personalidad y afectarla es una intromisión severísima en los

derechos de la persona que la ley cubana proclama a voz en cuello.

Que es la tortura psicológica si no la misma cosa? Que son los campos de

reeducación de Pol Pot, El Gulag, los campos nazis de trabajo donde

descaradamente se decía que el trabajo os har libres?

Abundando en el argumento de la patria potestad usurpada, debe apuntarse que

la alimentación es también por el estado que la raciona y priva de la leche a

los siete años. Ningún padre natural haría esto, ergo el verdadero padre es

el estado que actúa en esa capacidad de facto y de iure.

La patria potestad se define como el derecho de actuar por los menores de

edad y por el deber de alimentarlos, educarlos y protegerlos. Cuando se

cercenan esos derechos lo que se presenta es una apariencia de patria

potestad, que corresponde al estado marxista.

La persecución como se alega en el articulo que sigue y que es precedente

conocido, se puede probar por el ataque continuo a la personalidad que sufre

el joven en Cuba. No solo se debe considerar una persecución física . La

psicológica es evidente, diaria en la escuela e impuesta por ley.

Desconocerlo es una aberración jurídica vergonzosa. Es evidencia de una

actitud tendenciosa y de una vileza que por lo disimulada es de mal augurio

para los ciudadanos amantes de la libertad.

No es solo Elián, es la humanidad y la justicia entera la que sufre.

Much has been written as to why Elian Gonzalez should not return to Cuba.

Arguments are legion. However, this piece is targeted at the Immigration

Service's argument that the father is the only one that can speak for the

child. INS's argument is based on the fact that parents enjoy parental rights

over their children. No one argues this fact. It is in the body of western

law since time immemorial. The issue is whether Elians' father has real or

only apparent parental rights in Castro's Cuba and whether if even effective

rights existed he has the sole right to speak for the child.

This last issue was vividly illustrated by the case of Walter Polavcheck in a

well known case decided in Chicago during 1980. Walter, a 12 year old

Ukrainian boy was visiting the United States with his father and decided that

he did not want to go back. He took his bike and fled to his cousin's home.

The father went and got the police. Walter was helped by a lawyer on a pro

bono basis and fought his father for 5 1/2 years. Eventually he turned 18 and

was made a U.S. citizen and the issue of deportation became moot. But before

this happened the judge found that children have a right to be protected from

persecution and not only adults. In fact, the judge found that parental

rights are not absolute and this is only common sense. These rights are

exercised for the benefit of the child and not for his harm. It is a basic

principle of family law.

The question is then to determine whether parental rights exist in Cuba in

the way they are commonly understood and whether or not persecution exists. I

would rather not cite too many Marxist laws but it is necessary to do so.

The body of Cuban law that regulates children's rights is The Code of The

Child, Law No. 16 dated June 28 1978.

"Article 3. The communist formation of the young generation is a valued

aspiration of the state, the family, the teachers, the political

organizations, and the mass organizations that act in order to foster in the

youth the ideological values of communism.

Art 5. The society and the State watch to ascertain that all persons that

come in contact with the child during his educational process constitute an

example for the development of his communist personality.

Art 8. Society and the State work for the efficient protection of youth

against all influences contrary to their communist formation.

Art 9. Educators have a high mission in the development of the communist

personality.

Art 23. Upon completion of primary schooling young people may continue their

education at pre universitary centers, vocational schools, or other

specialized schools, on the basis of their academic achievement, political

attitude and social conduct.

Art.33. The State grants special attention to the teaching of

marxism-leninism due to its importance in the ideological formation and

political culture of the young students.

Art 68. Children and young people prepare for the patriotic/military

education by acquiring military knowledge, pre inductee courses, .....and

active military service making their own the principles of proletarian

internationalism and combative solidarity."

Yes, I know that the language is suffocating but it makes my case. What other

proof is required? Look at the contents of the law: Personality must change,

any influence contrary to communism must be combated, school admission is

predicated also on political attitude.

On top of this the Cuban constitution in its Art 39 states that the State

foments and orients education and insists that its cultural and educational

policy is based on "Marxist ideals" and again on the "communist formation" of

youth.

To cap it off Art 62 of the Cuban constitution states "that no rights granted

by this constitution can be exercised against the existence of and

objectives of the communist state. The infraction of this article is

punishable."

Pretty clear: if you are not a communist you are a criminal.

And what does the Declaration of Human Rights say?

Art.12 "No one shall be subjected to arbitrary interference with his privacy,

family, home or correspondence, nor to attacks upon his honor and reputation.

Everyone has the right to the protection of the law against such interference

or attacks."

Art.22. " Everyone, as a member of society,.... has the rights indispensable

for his dignity and the free development of his personality."

Art.18. Everyone has the right to freedom of thought, conscience and

religion.

Art.19. Everyone has the right to freedom of opinion and expression. This

right includes freedom to hold opinions without interference and to seek,

receive and impart information and ideas through any media and regardless of

frontiers.

Art 26 . Every person has a right to education. Education shall have as its

objective the full development of the human personality. Parents shall have

the right to choose the education given to their children.

The alleged parental rights accruing to Elians' father do not exist as they

have been usurped by the Marxist state in violation of Cuba's' legal

tradition and western legal thought. It assumes arbitrarily the right to

educate, indoctrinate and change the personality. At eleven years of age it

imposes a boarding school requirement and separates parents from children.

These rights are so basic and are so much of the essence of parental rights

that they exist in the codes of all civilized nations. The declaration of

human rights simply registers the consensus of humanity's secular

understanding of these matters.

Changing the personality is a most severe transgression of the rights of the

person but the Cuban law boasts about it in a loud voice.

What is the difference between this and psychological torture? (covered by

treaty and US law) What is the difference between this and the Gulag, Pol

Pot's reeducation camps or the nazi work camps, where the nazis shamelessly

said that work shall make you free?

And to further the argument of usurped parental rights it must be said that

nutrition, a basic right and obligation of parents is also usurped by the

state which rations and deprives children of milk at age seven. It acts as a

parent both "de facto" and "de iure".

Parental rights are defined as the right to act for a minor and the right and

obligation to feed, educate and protect children. When these rights are taken

away what is left is a reduced parental right which is slighted in such away

to render it meaningless. But nonetheless, this appearance is used and abused

by the State who shamelessly presents it as an argument to maintain its

tyranny.

The fact is: The real parent is the Marxist state.

Persecution in Cuba is obvious. The precedent established by Walter

Polavchek's case cannot be dismissed. Young people in Cuba are persecuted.

Not only physically. Psychological persecution is daily and imposed by law.

To oppose it is punishable by a constitutional article. What further proof is

needed of Castro's obsession with mind control to give little Elián

injunctive relief?

A guardian should be appointed by a family court to argue the child's case.

Anything else is a travesty of justice. When justice is disregarded in

matters such as these it is not only the child, but humanity that suffers.

En Cuba la Patria Potestad la Ejerce Fidel Castro

Es preciso repetir hasta la saciedad que la custodia del niño Elián González en teoría corresponde a su padre, pero en la práctica no es así, porque su padre está sometido a la jurisdicción de un Estado totalitario, de una tiranía absoluta que tiene control ilimitado sobre los ciudadanos y sobre las instituciones de lo que fue la República de Cuba. En Cuba, en lo que respecta al control de los niños, la llamada "patria potestad" la ejerce Fidel Castro. La decisión de la jueza Rosa Rodríguez, independientemente de cualquier argumento que alguien invoque contra ella, es correcta y cuenta con el respaldo de quienes conocen la durísima realidad jurídica, moral, económica y social de la nación cubana, gobernada en un sentido absoluto --y este concepto no es exagerado en modo alguno-- por Fidel Castro. Ese Fidel Castro es el que está organizando, dirigiendo y rodeando de argumentos falaces la tesis de que el niño Elián González debe ser enviado por las autoridades estadounidenses a Cuba.

En forma enfática el padre del niño ha dicho que no tiene por qué venir a Miami a buscar a su hijo y ha agregado, de manera irritante y clara, que a él no se le ha perdido nada en los Estados Unidos de América. Normalmente, humanamente, sentimentalmente --por encima de conceptos jurídicos reales o ficticios-- el hecho de que su hijo esté en los Estados Unidos en situación conflictiva con respecto a su status, debería de ser suficiente razón para que él padre no diga semejante barbaridad que demuestra que no tiene sentimientos o, que si los tiene, están ahogados en ese mar profundo totalitario de la tiranía de Fidel Castro. El padre, Juan Manuel González, no tiene en absoluto libertad alguna para opinar como padre ni como ciudadano. Por eso, no tiene más camino que repetir lo que son las consignas oficiales de ese Estado totalitario concebidas y proclamadas insistentemente por Fidel Castro.

Basta ver los gigantescos desfiles "populares" que se están llevando a cabo en La Habana y en casi todas las ciudades importantes de Cuba reclamando la presencia del niño, para darse cuenta que son las típicas concentraciones "populares" de los regímenes totalitarios. Cualquiera que recuerde o que haya visto en alguna oportunidad los desfiles de la Alemania de Hitler, por ejemplo, encuentra la similitud que hay entre esos desfiles y demostraciones y las que está montando ahora la tiranía de Castro en toda Cuba. Hay que ver en esos desfiles de niños, adolescentes y jóvenes que responden a una disciplina rígida, férrea, una prueba incontrovertible de la naturaleza y esencia del sistema comunista que padece el pueblo cubano desde hace cuarenta y un años.

In Cuba, Paternal Rights are Controlled by Fidel Castro

It is necessary to repeat and repeat that the custody of Elián González in theory belongs to his father, but in practice this is not the case, because his father is subjected by a totalitarian State, by an absolute tyranny that wields unlimited control over its citizens and over the institutions of what used to be the Republic of Cuba. In Cuba, with respect to control over children, the so called "patria potestas" is held by Fidel Castro. The decision of Judge Rosa Rodríguez, albeit any argument that anyone might have, is correct and has the support of all those who know the harsh juridical, moral, economic, and social reality of the Cuban nation, ruled in an absolute sense --and this is no exaggeration-- by Fidel Castro. That Fidel Castro is the one organizing, directing, and surrounding with false arguments the thesis that Elián González should be returned to Cuba by the American authorities.

The boy' s father has said emphatically that there is no reason for him to come to Miami and he has added, in an infuriating and clear way, that he has nothing to do in the United States of America. Normally, humanly, sentimentally --beyond any real or ficticious juridical concepts-- the fact that his son is in the United States in a conflicting situation regarding his status, should be more than enough reason for the fatheránot to say such a preposterous thing that shows that he has no feelings or, that if he has any, they are submerged in that profound totalitarian sea of Fidel Castro' s tyranny. The father, Juan Manuel Gonzalez, has no freedom whatsoever to give an opinion as a parent or as a citizen. That is why the only thing left for him to do is to repeat the official slogans of that totalitarian state, conceived and insistently proclaimed by Fidel Castro.

It suffices to see the huge "popular" demonstrations that are taking place in Havana and in almost every important Cuban city demanding the return of the child, to realize that these are the typical "popular" demonstrations of the totalitarian regimes. Anyone who remembers or who has seen at some time the demonstrations in Hitler' s Germany, for example, can notice the similitude between those marches and demonstrations and what the Castro tyranny is now organizing in Cuba. Seeing those demonstrations by children, teen-agers and youths that respond to a rigid, iron-fisted discipline, is an undeniable proof about the nature and essence of the communist system that the Cuban people have been suffering for forty-one years now.

Denuncian que la escuela de Elián en Cuba está en un estado deplorable

Fue una visita relámpago, pero a Sonia Pérez jamás se le van a olvidar las imágenes que vio ese mediodía en una escuela primaria de la ciudad de Cárdenas, al este de La Habana, a comienzos del pasado octubre.

El centro educativo lleva por nombre Marcelo Salado --un mártir de la lucha contra el régimen de Fulgencio Batista-- pero ahora se le conoce como la escuela a la que existía el niño Elián González --un sobreviviente del trágico naufragio, el Día de Acción de Gracias, en que perecieron cubanos huidos de la isla.

``Me dio la impresión de un presidio'', recordó Pérez, de 38 años, una agente de bienes raíces que llegó al exilio junto a sus padres en 1966. ``Dios mío, ¿cómo es que se puede enviar a un niño por ocho horas a un lugar así?''

Después de una larga ausencia de Cuba, Pérez decidió volver a Cuba motivada por un reclamo familiar. Su esposo, Joaquín Pérez, quiso complacer a su padre de 89 años con el regalo de cumpleaños que le había pedido: visitar la isla.

Con los Pérez viajó María Hanna, amiga de la familia y natural de Cárdenas, quien quiso incluir en el recorrido su ciudad natal y la primera escuela adonde había asistido allí antes de 1959.

``Fue un shock'', relató Pérez a El Nuevo Herald. ``Estuvimos sólo unos minutos pero aquello era un espectáculo dantesco: no había electricidad ni agua corriente, los servicios sanitarios situados dentro de las aulas apestaban, los pisos estaban sucios, las moscas volaban por todas partes...''

Viendo la televisión durante una visita a Orlando, se percató que la escuela donde estaban produciéndose las protestas era la misma que había visitado semanas atrás.

Señaló que le fue difícil acceder al lugar, un antiguo colegio religioso, pues la directora Maribel Reyes les dijo que previamente debían pedir un permiso de la policía local. ``Pero finalmente la convencimos explicándole que nos íbamos de la ciudad ese mismo día''.

Entonces la directora les acompañó en un breve recorrido por el recinto con la advertencia de que no podían tomar fotos. La única imagen la tomó Pérez en un momento en que Reyes las dejó solas en el aula de primer grado.

El lunes fue imposible localizar telefónicamente a Reyes, quien ha hablado con frecuencia durante las manifestaciones masivas en Cuba pidiendo el regreso de Elián a su pupitre.

Pero según Pérez, el peor recuerdo fue cuando salieron al patio a la hora de almuerzo.

``Los niños tenían que coger del piso unas bandejas metálicas con partes oxidadas y pasar en fila frente a unas cazuelas donde les servían arroz y lentejas a pleno sol. Y lo peor es que tenían que ir a comerse el almuerzo sentados en las aulas, con falta de luz y sin la higiene mínima, porque el comedor estaba clausurado'', pormenorizó.

Pérez manifestó que cuando llegó a Cuba tenía mucho interés por obtener información de primera mano sobre el sistema de educación, que es gratuita. ``Cuando uno viaja a otras partes del mundo, la gente habla de los logros educacionales de Cuba, pero lo que vi me dejó espantada... Me dolería que mi hija de ocho años tuviera que instruirse en esas condiciones''.

The Life of Six Year Old Elian Gonzales is in Bill Clinton's hands

Elian Gonzales, a 6-year-old Cuban boy, found Thanksgiving Day clinging to an inner tube off the coast of Florida, is about to be deported back to Communist Cuba on January 14, 2000 if the United States Immigration and Naturalization Service (INS) has its way.

It was the objective of Elian's mother, before she and nine other people drowned while fleeing Communist Cuba, for the boy to live in the United States where he would have the prospect of a bright future as a free man. According to the Clinton Administration, dictator Fidel Castro, and supposedly the father Juan Miguel Gonzalez (who demanded the return of his son after Castro did) Elian should be delivered back to Cuba.

Should Elian be returned to the slave state of Cuba or should he live with his paternal relatives in the United States as his mother wished.

If Cuba were a free country--one that respected individual rights as an absolute--there would be no question, given his mother's death, that Elian's father should have custody of Elian. Unfortunately, Cuba is communist dictatorship. This complicates matters greatly. The issue is not that the American government will not let Elian's father come to America--it is that the Cuban government will not allow Elian's father and new Cuban family to leave.

Parents do not own their children, but are guardians who make decisions in their child's best interest, until the child becomes an independent adult. Is it in Elian's best interest to shipped to Cuba, to perhaps die later while trying to escape Cuba as his mother did? What kind of father would want his son to live in a dictatorship, when his son has a chance to live in a free country?

In fairness to Elian's father, given the lack of free speech in Cuba, we cannot know what the father's real position is. In all likelihood, Juan Miguel Gonzalez wants his son to stay in the United States, and he would love to bring his new family in Cuba, that he acquired since divorcing Elian's mother, to join Elian in America.<O:P</O:P

Unfortunately, the last time Castro caught some courageous Cubans attempting to leave his island paradise, according to the Washington Post, Castro sunk their boat while the women were trying to keep their children's heads above water. Does any sane person think that a man who does not blink an eye when it comes to sinking a boat with children honestly care about Elian's welfare?

Given Fidel Castro's brutal human rights record, one can be certain of Gonzalez's fate if he even suggested joining his son in the United States--especially since Castro has coordinated rallies with thousands of Cubans demanding the return of Elian. Such a slap in Castro's face would surely result in Gonzalez spending years of his life in a Cuban prison, not to mention the persecution that his new family in Cuba would have to go through for his disobedience. It is understandable why Juan Miguel Gonzalez tows the Castro line: one cannot speak freely when a gun is held to ones head and the heads of ones family.

If you were in Elian's fathers shoes what would you do? How can one choose between the lives of ones loved one in Cuba and the life of your loved ones in America? Such is the impossible choice Elian's father is placed in by Castro. Morally Gonzalez cannot be blamed for choosing either way--he was damned if he did, and damned if he did not. Yet, the INS with the support of the Clinton administration and those in the media who advocate Elian's deportation choose not to take any of these facts into account. Ask yourself: why?

Some commentators have asked what does Elian want to do. Elian is not old enough to make his own decision. However, if he were the person to make such a decision, what does Elian desire? Senator Bob Smith, R-N.H., a member of the Senate Judiciary Committee which has INS oversight, met with Elian and reported that Elian told him in Spanish: "Help me. I don't want to go back to Cuba."

The only proper interest in this case is that of young Elian Gonzales. What is in Elian's best interest: Life in America or life in a tropical prison camp? The answer should be obvious.

It was obvious to Elian's mother. Elian's mother died trying to escape Cuba with her son. Elian's mother found freedom worth the risk of dying for--and unfortunately she did die, thanks to the Castro regime. Now, thanks to the Clinton administration backed INS policy, her death may be in vain.

Commented Elian's cousin Marisleysis Gonzalez on NBC's Today show, "I always thought this was a place of liberty, and they are not letting him keep that liberty. It's always about the father. What about the mother? That [Elian live in U.S.] was his mother's will."

The fundamental issue is not about "Florida's large and politically powerful anti-Castro Cuban community" versus the "bond between parent and child" as one commentator insinuated (USA Today 7 Jan 2000). There is something far more important than the "parental bond" between Elian's father and "the dignity of the Cuban people" as Elian's father referred to his son in a Castro sponsored rally (observe that even Elian's father admits that his son is first and foremost a political tool). That something is Elian's inalienable right to his own life--in Cuba that inalienable right does not legally exist.

What about "the bond between parent and child" broadcasted throughout the media by American leftists? Observe that historically these same leftists will call for the trampling of the rights of parents in any other issue: whether in violating a parent's right to determine the content of their child's education, or violating a parent's right to determine who their child spends time with (Troxel v. Granville), or violating a parent's right to decide what moral code their child will live by, etc.

The sudden, uncharacteristic urge of the Left to support "family values" is just the last card in a "game" where they were bankrupted long ago. The only reason they use that card now, since it does not apply, is that "family values" serves as a smokescreen for the real source of their affection: collectivism.

American Leftists regard Communist Cuba as a moral ideal--and America as its antithesis. They see communism as a good theory that oddly does not work in practice. What they have yet to discover is that the reason why collectivism (in all its forms) does not work in practice is that it is evil in theory (American Cubans know this first hand).

It is the Leftists' hatred of American values and individual rights that allows them to pretend that Elian's father is speaking freely. To them there is no fundamental difference between America and Cuba, and anyone who claims otherwise is guilty of "cultural imperialism", "Eurocentrism", "extremism" and a host of other fabricated, non-objective smears. If there is no difference between Cuba and the United States, why does Cuba have use force to keep people in, and why does the United States use force to keep people out? Why does Cuba jail people for political 'crimes'. Why are there no elections where Castro is not already declared the winner before the election is announced? Why does your vocal disagreement with the government land you five years in a food impoverished prison cell?

Imagine if the U.S. president actually acted pro-American, i.e., pro-individual rights, he would condemn Cuba, China, and every other slave state, rather then seeking to appease them. If he had moral fiber, he would grant custody of Elian to his paternal relatives in the United States, and demand that Castro allow all of Elian's Cuban relatives to immigrate to the United States to show that Elian's father is speaking of his own free will.

Of course, Castro will not do this: he knows that if there are no hostages to torture in Cuba, Elian's father will not come back--and the Clinton Administration is smart enough to know this too, which is why Clinton does not put his spiritual brother Castro in such an awkward position. The only villain in the picture is Castro, yet he cannot succeed without his accomplices in the white house, and the intellectuals in our TV stations, radio, and newspapers. These accomplices are the guilty parties. Elian--and the freedom that he represents--is the victim.

Piden intervención de la Iglesia Católica en el caso de Maritza Lugo

LA HABANA (NPC).- En carta enviada a Su Santidad Juan Pablo Segundo, al Cardenal Jaime Ortega y Alamino, del Arzobispado cubano, y a la Nunciatura Apostólica, miembros de varias organizaciones opositoras y familiares presentes en la vigilia de la finca Baraguá, pidieron su intervención ante las autoridades cubanas por la libertad de Maritza Lugo Fernández, presidenta en funciones del Partido Democrático 30 de Noviembre Frank País:

Ciudad de La Habana, 9 de enero del 2000

Hermanos:

Esperamos que al recibo de esta carta se encuentren disfrutando de buen estado de salud, tanto físico como espiritual, con el favor y la bendición de nuestro Padre Celestial y nuestro Señor Jesucristo.

Nos dirigimos a ustedes para hacerlos partícipes de las injusticias de que está siendo objeto una hija de Dios.

La hermana Maritza Lugo Fernández es miembro activa de la Iglesia Católica, de la comunidad Sagrado Corazón de Jesús, en el Diezmero, madre de dos niñas de 17 y 9 años, con residencia en la finca Baraguá, calzada de San Miguel del Padrón, entre calle Otero y Avenida de las Palmas, Mirador del Diezmero, San Miguel del Padrón, Ciudad Habana.

La señora Maritza Lugo fue arbitrariamente detenida en su domicilio el 23 de diciembre de 1999 y trasladada para el Departamento Técnico de Investigaciones, en 100 y Aldabó, Ciudad Habana, con el pretexto de que iba a promover desórdenes públicos en la procesión que se efectuó el pasado 25 de diciembre de 1999, lo que es una vil mentira, ya que nuestra hermana quería participar junto a otros hermanos en dicha procesión como católica practicante que es, y de la cual fue privada.

¿Querer participar en una procesión de la Iglesia, convocada por la misma es cometer desorden público, no tiene derecho un católico practicante a participar en las convocatorias de su Iglesia?

Hace más de 15 días que nuestra hermana se encuentra detenida en condiciones infrahumanas en las celdas de 100 y Aldabó, privándola de esta forma, de estar junto a sus hijas y demás familiares durante la celebración de las fiestas navideñas y el advenimiento del nuevo milenio. No se puede mantener a una madre, por motivos infundados, alejada de sus hijas. Con esta acción se priva de sus derechos a nuestra hermana de participar en las actividades que convoca la Iglesia.

Les suplicamos intercedan poránuestra hermana y no permitan, con el favor de Dios, que sea encausada injustamente.

Esperamos que Dios derrame su espíritu santo para que puedan ayudar a nuestra hermana Maritza Lugo Fernández, la cual sufre injusto encierro por delitos no cometidos y Dios sabe que es cierto todo lo expuesto aquí.
